Staff Position Creation and Classification Procedures

Position Approvals

Departments should coordinate with their assigned HR Business Partner on all requests to create new or update existing staff positions. Approvals needed to create or update staff positions will vary based on job classification and funding source.
 

Position Classifications

Following are the various classifications of staff employee positions that exist or may be created, if approved, at BYU. Weekly hours expectations for each position classification are based on the university workweek as defined in the university Work Schedule, Break, and Meal Period Policy. Part-time positions must also meet the requirements outlined in the university’s Part-Time One Employer Policy.

Full-Time, Exempt

  • Meets the exemption criteria provided in the Fair Labor Standards Act (FLSA) and are exempt from the overtime provisions of the FLSA
  • · Paid monthly on a salary basis
  • · Expected to work a minimum of 40 hours each workweek
  • · May work more than 40 hours in a workweek to complete job responsibilities; does not receive overtime pay (see Staff and Student Employee Overtime Policy)
  • · Eligible for full benefits

Full-Time, Non-Exempt

  • · Full-time position
  • · Not exempt from the overtime provisions of the FLSA
  • · Expected to work a minimum of 40 hours each workweek
  • · Paid bi-weekly on an hourly basis
  • · Eligible for full benefits

Part-Time Benefited, Exempt and Non-Exempt

  • · Part-time, non-student position
  • · Scheduled to work 28 or fewer (but more than 20) average weekly hours over the annual ACA measurement period
  • · Positions that meet the exemption criteria provided in the FLSA may be hired on contract (subject to Staff Compensation approval) and are exempt from the overtime provisions of the FLSA
  • · Paid bi-weekly on an hourly or contract (for exempt) basis
  • · Eligible for retirement benefits including:
  • o TIAA 403(b)
  • o Deseret 401(k)
  • o Master retirement plan and/or the Employer Discretionary Retirement Contribution (EDRC)
  • · Not eligible for medical benefits or paid leaves
  • · For use when student employee positions are not practicable or available

Part-Time Non-Benefited*, Exempt and Non-Exempt

  • · Part-time, non-student position
  • · Scheduled to work no more than 17.5 average weekly hours or 910 total hours over their initial 12-month employment period and each calendar year thereafter
  • · Positions that meet the exemption criteria provided in the FLSA may be hired on contract (subject to Staff Compensation approval) and are exempt from the overtime provisions of the FLSA
  • · Paid bi-weekly on an hourly or contract (for exempt) basis
  • · Eligible for TIAA 403(b) retirement benefit
  • · Not eligible for medical benefits or paid leaves
  • · For use when student employee positions are not practicable or available

* If an employee is hired into a part-time non-benefited position who has previously worked for BYU for at least 1,000 hours in a calendar year (with Vice President approval), they will also be eligible for the Deseret 401(k), Master retirement plan and/or the Employer Discretionary Retirement Contribution (EDRC).

Seasonal Employee, Exempt and Non-Exempt

  • · Part-time, project-based position in approved areas
  • · Paid bi-weekly on an hourly or contract (for exempt) basis
  • · An employee in this position category may not do any of the following:
  • o Represent the university at conferences or official gatherings
  • o Make decisions that impact the university or its resources
  • o Attend educational or training conferences
  • o Receive an annual performance evaluation or an annual merit increase
  • o Serve on university committees
  • · Not eligible for benefits

Part-Time Rehired Retiree, Non-Exempt

  • · Retired full- and part-time staff rehired part-time under the Postretirement Employment Policy; must meet eligibility requirements as outlined in the Postretirement Employment Policy
  • · Paid bi-weekly on an hourly basis
  • · May work up to 910 hours per year for up to three consecutive years immediately following retirement, but may not work more than 20 hours per week
  • · An employee in this position category may not do any of the following:
  • o Represent the university at conferences or official gatherings
  • o Make decisions that impact the university or its resources
  • o Attend educational or training conferences
  • o Receive an annual performance evaluation or an annual merit increase
  • o Serve on university committees
  • · Not eligible for retirement benefits
  • Cosmetologist, Non-Exempt
  • · Part-time, non-student employee hired as a barber, hairstylist, or esthetician at Studio 1030 or the MTC Barbershop.
  • · Paid bi-weekly on commission
  • · Not eligible for benefits
