Drug-Free Workplace Procedures

All individuals employed by the university will receive a copy of the Drug Free Workplace Policy at least annually.

Employees of the university convicted of violating a criminal drug statute inside OR outside of the workplace must notify their immediate supervisor or the Principle Investigator of the conviction, in writing, no later than five calendar days after the conviction.  Failure to provide notification in writing of a conviction will be cause for disciplinary action up to and including immediate termination of employment.

If the employee is working on a federal contract or award, the immediate supervisor or Principle Investigator is responsible to immediately notify the Executive Director of the Office of Research and Creative Activities.  The Executive Director, Office of Research and Creative Activities, will notify all affected federal agencies within ten days of receiving notice of the conviction in compliance with 34 CFR 84.225(a).  The Executive Director of the Office of Research and Creative Activities will then notify the Employee Relations or Faculty Relations, as appropriate, and, in consultation with the employee’s management, take appropriate personnel action against the employee, up to and including termination, consistent with the requirements of the Rehabilitation Act of 1973 (29 U.S.C. 794), as amended and the CES Honor Code.

In the event the employee was engaged in the performance of a federal award or contract, these actions must be taken within 30 calendar days of learning about an employee's conviction.  The responsibility for compliance and levy of any sanctions for non-compliance with the performance of the contract or grant will be with the Principal Investigator, college or department and not with the university as a whole.

In the event there is a violation of the Drug Free Workplace Policy and the employee is not working on a federal contract or award the immediate supervisor will then notify the Employee Relations or Faculty Relations, as appropriate, and, in consultation with the employee’s management, take appropriate personnel action against the employee, up to and including termination of employment.

The employee may be subject to criminal penalties under applicable federal and state law.
